About these terms

These Terms and Conditions govern your access to and use of TYFM, including its website, dashboard, Discord integration, reminder functionality and related services.

TYFM is operated by Ryan O'Flaherty ("TYFM", "we", "us" or "our").

By creating an account or using TYFM, you agree to these Terms. You must not use TYFM if you do not agree to them.

Privacy and cookies

Our Privacy Policy explains how we collect, use and protect personal information.

Our Cookie Policy explains how TYFM uses cookies, analytics and similar technologies.

The TYFM service

TYFM provides tools designed to help users schedule medication reminders, receive accountability prompts, record confirmations and monitor user-entered medication stock levels.

Features may be delivered through the TYFM website, Discord or other supported platforms.

We may add, change, suspend or discontinue features as the service develops.

Your responsibility

You remain responsible for managing medication safely, regardless of whether TYFM sends or fails to send a reminder.

You are responsible for:

• Entering accurate medication, dosage, schedule and stock information.
• Checking that reminders have been configured correctly.
• Confirming whether medication has actually been taken.
• Checking medication packaging and professional instructions before taking a dose.
• Maintaining an alternative method of managing important medication.
• Protecting your Discord and TYFM accounts.

Stock figures, dose histories and next-dose information are based on information entered by users. They may be incomplete or inaccurate and must not replace checking the medication itself.

Reminder delivery and availability

We aim to provide a reliable service, but we do not guarantee that TYFM will always be available, accurate, uninterrupted or error-free.

Reminders may be delayed, duplicated or not delivered due to circumstances such as:

• Discord outages, restrictions or API failures.
• Internet, mobile network or device problems.
• Hosting, database or queue failures.
• Incorrect reminder or time-zone configuration.
• Expired, revoked or unavailable account access.
• Maintenance, security incidents or other technical failures.

You should not use TYFM as your only means of remembering medication where missing a dose could cause harm.

Accounts

You must provide accurate information and must not create an account using another person's identity without authority.

You are responsible for activity carried out through your account. Contact us promptly if you believe your account has been accessed without permission.

You must be legally capable of entering into a binding agreement. Where TYFM is used to manage information about a child or another person, you must have appropriate authority to do so.

Subscriptions and payment

Some TYFM features require a paid subscription. The price, billing interval and features included in the subscription will be shown before you purchase.

Payments and subscription billing are processed by Stripe. By purchasing a subscription, you may also be subject to applicable Stripe terms governing its payment services.

Unless stated otherwise, paid subscriptions renew automatically at the end of each billing period using the payment method associated with your subscription until cancelled.

If you are a consumer, you have a statutory right to cancel a new subscription within 14 days of subscribing, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To exercise this right, contact us at support@tyfm.io or use the billing controls in your account, and we will refund the amount you paid for that subscription. This 14-day right applies to your initial subscription and does not restart with each renewal.

You may manage or cancel your subscription using the billing controls made available by TYFM. Outside the 14-day period described above, cancellation prevents future renewals but does not ordinarily refund amounts already paid.

Unless otherwise stated, you will normally retain access to paid features until the end of your current paid billing period after cancellation.

If a payment fails or cannot be completed, access to paid features may be restricted or ended after any applicable retry or grace period.

Prices may change from time to time. Where a price change affects an existing subscription, we will provide reasonable notice where required by law before the new price applies.

Nothing in this section affects any cancellation, refund or other rights that you have under applicable consumer law.

Referral offers and discounts

TYFM may offer referral benefits, promotional prices or subscription discounts. The conditions shown with an offer form part of these Terms.

Referral benefits may depend on referred users remaining eligible, active and paying customers.

We may refuse or remove benefits where referrals are fraudulent, misleading, duplicated, self-generated or otherwise abused.

We may change or withdraw a referral programme, but will not remove benefits already earned except where abuse, error or another stated condition applies.

Acceptable use

You must not:

• Use TYFM unlawfully or to harm another person.
• Attempt to access another user's account or private information.
• Interfere with, overload or disrupt TYFM or its infrastructure.
• Probe for vulnerabilities without written authorisation.
• Circumvent access, subscription or security controls.
• Use automated systems in a way that places unreasonable load on TYFM.
• Copy, resell or exploit TYFM except where expressly permitted.

Suspension and termination

We may restrict, suspend or terminate access where we reasonably believe that:

• These Terms have been breached.
• The service is being abused.
• Payment is overdue or has failed.
• Suspension is necessary to protect TYFM, its users or third parties.
• We are required to do so by law.

You may stop using TYFM and request account deletion at any time, subject to any outstanding payment obligations.

Intellectual property

TYFM and its software, branding, design, text and other content are owned by us or licensed to us.

We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use TYFM in accordance with these Terms.

Discord and other third-party names and marks belong to their respective owners. TYFM is not endorsed by Discord unless expressly stated.

Third-party services

TYFM relies on services operated by third parties, including Discord, Stripe and hosting and infrastructure providers. Their availability and operation are outside our complete control.

Your use of third-party services may also be governed by their own terms and policies.

Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to those protections, we are not responsible for loss caused by:

• Missed, late, duplicated or incorrect reminders.
• Inaccurate information entered or confirmed by a user.
• Decisions made in reliance on stock calculations, dose histories or reminder information.
• Discord, Stripe or another third-party service.
• Events that were not reasonably within our control.

TYFM is primarily supplied for personal use. We are not responsible for business losses such as lost profits, revenue, contracts or opportunities.

Where permitted by law, our total liability relating to a paid TYFM subscription will not exceed the amount you paid to TYFM during the twelve months preceding the event giving rise to the claim.

Your statutory consumer rights are not affected.

Changes to these Terms

We may update these Terms to reflect changes to TYFM, legal requirements, security needs or business practices.

Where a change materially affects existing users, we will provide reasonable notice where practicable. Continuing to use TYFM after the revised Terms take effect means you accept them.

Governing law

These Terms are governed by Scots law.

The Scottish courts will have jurisdiction, except where applicable consumer law gives you the right to bring proceedings elsewhere.
